Early Access and Beta Features

The Service, or certain features of the Service, may be offered in early access, beta, or experimental form. Such features are provided for evaluation and testing purposes and may be incomplete, unstable, or subject to change.

Fontish may modify, suspend, or discontinue early access features at any time and does not guarantee availability, functionality, or data persistence during the early access period.

During early access, Fontish may offer subscription plans at reduced or provisional pricing. Users who subscribe during early access may retain their early access price for as long as their subscription remains active and uninterrupted.

Retaining an early access price applies only to the specific plan, features, and usage limits included at the time of subscription. Early access subscribers are not entitled to new features, increased limits, or additional value introduced in later plans or pricing tiers unless they choose to upgrade.

Commercial use

Reference Images and Copyright Guidance

Our font generation process is designed to generate original typefaces based on limited reference material. To reduce the likelihood that a generated font could be considered substantially similar to an existing font, users who intend to use generated fonts for commercial purposes are encouraged to limit reference images to a maximum of four glyphs. This approach is intended to encourage the system to interpret stylistic characteristics and generate new letterforms rather than reproduce existing designs.

This four-glyph guideline does not apply to personal use. For commercial use, adhering to this guideline may help reduce the risk of similarity to existing fonts. However, Fontish does not guarantee that generated fonts will be free from resemblance to third-party works, as determinations of similarity and infringement depend on context and applicable law.

For additional risk mitigation, users are advised to use reference images derived from fonts that are legally licensed. This measure is optional and provided solely as a precaution. Using legally licensed reference material may reduce legal risk but does not affect the user’s responsibility to ensure that the generated font can be lawfully used for its intended purpose.

Users are solely responsible for reviewing generated fonts prior to any commercial use. If a generated font appears substantially similar to an existing font or reference material, users are responsible for refraining from use, modifying the font, or taking other appropriate corrective action.

Fontish assumes no responsibility for the selection of reference materials or for the use, distribution, or commercialization of generated fonts. Users assume full responsibility for ensuring compliance with applicable intellectual property laws. Fontish shall not be liable for any claims, damages, or disputes arising from the use of reference images or generated fonts.

Our Right to Use Generated Fonts

By using the Service, you grant Fontish a perpetual, worldwide, royalty-free license to store, use, reproduce, analyze, and modify a copy of generated fonts for purposes including improving and training the Service, developing new features, products, or services, and research and analytics.

This license does not limit your rights to use, modify, distribute, or commercialize generated fonts.

In the future, Fontish may offer plans that allow users to generate fonts without Fontish retaining a copy. Any such plans, if offered, will be subject to separate terms and conditions.

This license and Fontish’s right to retain copies of generated fonts survive account deletion or termination, to the extent permitted by applicable law.

User Content

You retain ownership of any original content you upload to the Service, including reference images and design inputs.

You grant Fontish a limited, non-exclusive license to use, store, and process such content solely for the purpose of providing and improving the Service.

Subscription and Payment Terms

Access to the Service requires an active subscription. Subscription pricing, billing cycles, renewals, cancellations, and refund policies are described in Fontish’s Pricing and Billing Policy. By purchasing a subscription, you authorize Fontish to charge your selected payment method on a recurring basis in accordance with your chosen plan. Subscriptions automatically renew at the end of each billing period unless cancelled prior to renewal.

Each subscription period includes a defined number of generation credits and regeneration credits. Generation credits are used to create character sets, such as A-Z, a-z, or 0-9. Regeneration credits are used to regenerate individual glyphs within the Service.

Credits have no monetary value and cannot be exchanged, transferred, or sold. Credits may only be used within the Service and remain valid for a limited period from the date of issuance, as specified in the applicable plan. Any unused credits expire automatically at the end of their validity period and do not roll over unless expressly stated otherwise.

Annual subscriptions are paid in full at the time of purchase and renew automatically each year unless cancelled before renewal. Annual plans may be offered at a discounted price. Included generation and regeneration credits are provided periodically under the applicable plan, rather than all at once at the time of purchase. Cancellation prevents future renewals but does not affect access for the remainder of the current billing period. Refund eligibility is subject to the refund terms set forth below.

You may cancel your subscription at any time through your account settings or other designated cancellation method. Cancellation will take effect at the end of the current billing period, and access to the Service will continue until that time. Unless otherwise stated, fees are non-refundable.

Subscriptions are eligible for a refund only if no credits have been used. Refund requests must be submitted within 30 days of the applicable charge date. Charges incurred more than 30 days prior to the refund request are not eligible for a refund, even if no credits have been used. Once any credits have been used to generate or regenerate fonts, the subscription is no longer eligible for a refund. Refund requests must be submitted through Fontish’s designated support channels.

Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without prior notice, if you violate these Terms or engage in conduct that may harm Fontish, other users, or third parties.

You may delete your account at any time by accessing the account deletion option available through the user menu within the Service or by contacting Fontish directly through the designated support channels. Selecting the account deletion option will initiate the account deletion process.

Upon termination, your right to use the Service will cease immediately. Any provisions of these Terms which by their nature should survive termination, including provisions related to intellectual property, licenses, disclaimers, limitations of liability, and dispute resolution, will survive termination.

Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Fontish disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fontish does not guarantee that the Service will be uninterrupted, secure, error-free, or free from harmful components.

Fontish does not warrant or guarantee the accuracy, quality, legality, or suitability of any fonts or other content generated through the Service. Use of the Service and any generated output is at your own risk.

To the fullest extent permitted by law, Fontish and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the Service, including but not limited to:

• Your access to or use of the Service
• Any unauthorized access to or use of Fontish systems or data
• Any interruption or cessation of the Service
• Any bugs, viruses, or harmful components transmitted through the Service

To the maximum extent permitted by applicable law, Fontish’s total liability for any claims arising out of or relating to the Service shall not exceed the amount you paid to Fontish in the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Fontish and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Force Majeure

Fontish shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure failures, or failures of third-party service providers.

Assignment

You may not assign or transfer these Terms, or any rights or obligations under them, without Fontish’s prior written consent. Fontish may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, or corporate restructuring.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with any policies or documents expressly incorporated by reference, constitute the entire agreement between you and Fontish regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings.
